Who We Are and What This Covers

Marketware Solutions LLC ("Marketware," "we," "us," or "our") is a web design and digital marketing company based in Texas that serves businesses across the United States.

This Privacy Policy applies to personal information we collect through this website, our client portal, our emails and calls, and our services. It does not apply to the websites we build for our clients. Each client is responsible for its own website's privacy practices, and we explain our role in handling that data in Data We Handle for Our Clients.

"Personal information" means information that identifies, relates to, or could reasonably be linked to you or your household. By using this website, you acknowledge the practices described in this policy and in our Terms & Conditions.

Information We Collect

Information you give us

  • Contact and inquiry details. When you fill out our contact form or reach out to us, we collect your name, business name, current website, email address, phone number, the services you're interested in, your timeline, and anything you write in your message.
  • Client and project information. If you become a client, we collect billing contacts, project content (such as text, photos, and logos), feedback, and the account access you share with us for things like your domain, hosting, Google Business Profile, analytics, and ad accounts.
  • Client portal account details. Your name, email address, and login credentials.
  • Payment information. Payments are handled by third-party payment processors. We receive limited details such as your name, billing address, and the last digits of your card or bank account. We do not store full card numbers.
  • Communications. Emails, call notes, meeting notes, reviews, and testimonials you send us.

Information collected automatically

When you visit our website, our hosting provider and the tools we use may automatically collect:

  • Your IP address and the approximate location (city or region) it suggests.
  • Your browser type, device type, operating system, and screen size.
  • The pages you visit, links you click, the site that referred you, and the date and time of your visit.
  • Your preferences, such as whether you chose light or dark mode.

Information from other sources

We may receive information about you from referral partners, review sites, advertising and analytics platforms, and public sources such as your business website, business listings, and social media profiles.

We do not intentionally collect sensitive personal information, such as Social Security numbers, health information, precise geolocation, or information about race, religion, or sexual orientation. Please do not send it to us through our forms.

How We Use Information

We use personal information to:

  • Respond to your questions and requests and send you proposals.
  • Plan, design, build, host, manage, and market the websites and campaigns we deliver for clients.
  • Run the client portal, send invoices, process payments, and keep business records.
  • Send service updates and, if you have agreed, occasional news and offers.
  • Understand how visitors use our website so we can improve it and measure our own marketing.
  • Protect our website, clients, and business from spam, fraud, and security threats.
  • Comply with legal, tax, and accounting requirements, and enforce our agreements.
  • For any other purpose we tell you about when we collect the information, or with your consent.

Cookies and Tracking

Cookies and similar technologies, such as local storage and pixels, are small pieces of data stored on your device. We use them in these ways:

  • Essential and preference. To make the website work and remember your choices, such as your light or dark mode setting.
  • Analytics. We may use analytics tools, such as Google Analytics, to understand how visitors find and use our website. These tools collect usage data and may set their own cookies.
  • Advertising measurement. We may use conversion tracking from advertising platforms, such as Google Ads, to see whether our own ads lead to inquiries.

You can block or delete cookies in your browser settings. Blocking some cookies may affect how the website works. To opt out of Google Analytics across websites, you can use the Google Analytics opt-out browser add-on, and you can manage Google ad personalization in your Google ad settings.

Global Privacy Control. We treat a Global Privacy Control (GPC) signal from your browser as a valid request to opt out of the sale or sharing of your personal information and of targeted advertising, for that browser.

Do Not Track. There is no common industry standard for "Do Not Track" browser signals, so our website does not respond to them. We do honor GPC, as described above.

How We Share Information

We share personal information only as described below:

  • Service providers. Companies that help us run our business, such as website hosting and form handling, email, scheduling, project management, cloud storage, accounting, payment processing, and analytics. They may use personal information only to provide services to us and must protect it.
  • Contractors. Trusted designers, developers, and writers who help with client projects and are bound by confidentiality obligations.
  • Platforms you ask us to work with. For example, when we set up your Google Business Profile, ad accounts, domain, or hosting on your behalf.
  • Legal and safety reasons. When we believe in good faith that the law, a court order, or a government request requires it, or to protect the rights, property, or safety of our business, our clients, or others.
  • Business transfers. If we are involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that deal, subject to this policy.
  • With your consent. Whenever you ask us to or agree that we may.

We Do Not Sell Your Information

We do not sell your personal information for money, and we do not knowingly sell or share the personal information of anyone under 16. We do not use your personal information for profiling that produces legal or similarly significant effects about you.

Some state laws treat certain uses of advertising cookies as a "sale," "sharing," or "targeted advertising," even when no money changes hands. If we use advertising tools that fall under those definitions, you can opt out at any time by emailing us or by turning on Global Privacy Control in your browser. We will not ask you to create an account to opt out.

Emails, Calls, and Text Messages

When you give us your email address or phone number, we use it to respond to you and to communicate about your project. We will only send marketing emails if you have agreed to receive them, and every marketing email includes a link to unsubscribe.

We will not send you marketing text messages unless you have given us your express consent. If you agree to receive texts, message and data rates may apply, message frequency varies, and you can reply STOP at any time to opt out or HELP for help. Consent to texts is never a condition of buying our services.

We do not share your phone number or text messaging consent with third parties or affiliates for their own marketing purposes.

Data We Handle for Our Clients

When we build, host, or manage a website or campaign for a client, we may handle personal information about that client's customers, such as contact form submissions, leads, or analytics data. In those cases, we act as a service provider or processor on behalf of our client. We process that information only to provide services to the client and according to the client's instructions, and we do not sell it or use it for our own marketing.

If you are a customer of one of our clients and have a question about your information, or want to exercise your privacy rights, please contact that business directly. If you contact us, we will forward your request to them and help them respond.

How Long We Keep Information

We keep personal information only as long as we need it for the purposes described in this policy, unless the law requires or allows us to keep it longer. As a general guide:

  • Inquiries that don't lead to a project: up to 2 years after our last contact with you.
  • Client records: for the length of our relationship, plus up to 7 years afterward for tax, accounting, and legal purposes.
  • Account access you shared for a project: deleted or returned when the project or service ends.
  • Website usage and analytics data: generally no longer than 26 months.
  • Marketing preferences and opt-outs: as long as needed to honor your choices.

When we no longer need personal information, we delete it or make it anonymous.

How We Protect Information

We use reasonable administrative, technical, and physical safeguards to protect personal information, including encrypted connections (HTTPS), access controls, strong passwords and two-factor authentication where available, and limiting access to people who need it.

No method of sending or storing data is completely secure, so we cannot guarantee absolute security. If a data breach affects your personal information, we will notify you and the appropriate authorities as required by the laws of Texas and of the state where you live.

Your Privacy Rights

Many states, including California, Texas, Colorado, Connecticut, Virginia, Utah, Oregon, Montana, Iowa, Delaware, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, and Rhode Island, give residents specific rights over their personal information. To keep things simple and fair, we extend these rights to everyone in the United States, whether or not your state's law requires it. Subject to legal exceptions, you may ask us to:

  • Know and access the personal information we have about you and how we use and share it.
  • Correct personal information that is inaccurate.
  • Delete personal information we collected from or about you.
  • Get a copy of your personal information in a portable, commonly used format.
  • Opt out of the sale or sharing of your personal information, targeted advertising, and profiling.
  • Limit the use of any sensitive personal information, where applicable.
  • Unsubscribe from marketing emails and texts at any time.

How to make a request

Email us at info@marketwaresolutions.com or call us at (832) 342-9532. Please tell us what you are asking for and the state you live in. To protect your information, we will verify your identity by matching details you give us with information we already have, and we may ask for more information if needed. We will respond within 45 days. If we need more time, we will tell you why, and we may take up to 45 more days where the law allows.

Authorized agents

You may use an authorized agent to make a request for you. We may ask the agent for proof of your signed permission and may ask you to verify your identity directly with us.

Appeals

If we decline your request, we will explain why. You may appeal our decision by replying to our response or emailing us with "Privacy Appeal" in the subject line. We will respond to your appeal within the time required by your state's law, generally 45 to 60 days. If we deny your appeal, you may contact your state's attorney general. For example, Texas residents may file a complaint with the Texas Attorney General.

No discrimination

We will never deny you services, charge you a different price, or give you a different level of service because you exercised your privacy rights.

State-Specific Disclosures

California

The California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"), requires us to describe our practices over the past 12 months. We have collected these categories of personal information:

  • Identifiers, such as your name, email address, phone number, and IP address.
  • Customer records described in California Civil Code Section 1798.80(e), such as billing details.
  • Commercial information, such as the services you purchased or considered.
  • Internet or network activity, such as pages viewed and how you interacted with our website.
  • Approximate geolocation based on your IP address.
  • Professional information, such as your business name and role.
  • Sensitive personal information, limited to client portal login credentials, which we use only to provide the portal and keep it secure.

We collect these categories from the sources, use them for the purposes, and disclose them to the categories of recipients described in the sections above. We disclose them for business purposes to service providers and contractors. We do not sell personal information, and we do not use sensitive personal information to infer characteristics about you. Retention periods are described in How Long We Keep Information.

Shine the Light. Under California Civil Code Section 1798.83, California residents may ask once a year for information about personal information we disclosed to third parties for their direct marketing purposes. We do not make those disclosures, but you may still email us to ask.

Texas

Texas residents have the rights described in Your Privacy Rights under the Texas Data Privacy and Security Act. We do not sell sensitive or biometric personal data. If that ever changes, we will post the notices Texas law requires before doing so.

Nevada

We do not sell covered information as defined in Nevada law. Nevada residents may still send an opt-out request to info@marketwaresolutions.com, and we will honor it if our practices change.

Colorado, Virginia, Connecticut, and other states

Residents of states with comprehensive privacy laws may exercise the rights and appeal process described in Your Privacy Rights. Where required, you may contact your state attorney general if you are not satisfied with the result of an appeal.

Washington and Nevada consumer health data

We do not collect consumer health data as defined by Washington's My Health My Data Act or similar laws in other states.

Children's Privacy

Our website and services are meant for businesses and adults. They are not directed to children, and we do not knowingly collect personal information from anyone under 18. We comply with the Children's Online Privacy Protection Act (COPPA). If you believe a child has given us personal information, please contact us and we will delete it.

Other Websites

Our website links to other websites, including our clients' websites, review sites, and social media. We are not responsible for the privacy practices of those websites, so we encourage you to read their privacy policies.

Visitors Outside the United States

We are based in the United States and our services are offered to U.S. businesses. If you visit our website from outside the United States, your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your country.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will change the effective date at the top of this page. If we make significant changes, we will let you know by email or with a notice on this website before they take effect. We review this policy at least once a year.
